1. The Services
NamiFusion provides AI-powered media generation, editing, workflow, marketplace, API, account, billing, and related services. The Services may include hosted software, models, APIs, credits, subscriptions, storage, documentation, support, and integrations with third-party providers.
The Services are intended for users who are at least 18 years old or otherwise able to form a binding contract. If you use NamiFusion on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Accounts and Security
You are responsible for the accuracy of account information and for all activity under your account, API keys, and workspace. Keep credentials confidential and notify us promptly if you suspect unauthorized access.
We may suspend or limit access where necessary to protect the Services, comply with law, prevent misuse, or investigate suspected violations of these Terms.
3. Inputs, Outputs, and Ownership
“Input” means prompts, images, video, audio, files, text, parameters, and other material you submit to the Services. “Output” means material generated or returned by the Services based on your Input.
You retain your rights in your Input. Subject to these Terms and applicable law, you own the Output generated for you. You grant NamiFusion a limited license to host, process, transmit, display, and store Input and Output solely to provide, maintain, secure, troubleshoot, and improve the Services.
AI Output may not be unique. Similar or identical results may be generated for other users. You are responsible for reviewing Output before using, publishing, distributing, or relying on it.
4. Acceptable Use
You may not use the Services to violate law, infringe rights, deceive others, impersonate people without authorization, create non-consensual intimate content, exploit minors, harass or threaten people, generate malware, evade safety controls, or produce content intended to facilitate fraud, abuse, or physical harm.
For face, voice, likeness, or identity-based features, you must have all rights, permissions, and consents required for your Input and intended use of Output. You are responsible for disclosures, labels, releases, and other compliance obligations that apply to synthetic or edited media.
5. APIs and Developer Use
If you use NamiFusion APIs, you must follow the documentation, protect API keys, maintain reasonable security for your applications, and ensure your end users comply with these Terms. You may not expose non-public user content to third parties without appropriate authorization.
We may apply rate limits, usage limits, model availability changes, safety filters, and technical restrictions. API behavior, models, pricing, and performance may change over time.
6. Credits, Subscriptions, and Payment
Paid features may require credits, subscriptions, or other fees. Subscription plans may renew automatically unless cancelled before the renewal date. Taxes, exchange fees, and payment processor charges may apply.
Credits are not cash, are non-transferable, and may expire or be limited as disclosed at purchase or in the applicable plan. Except where required by law or expressly stated, payments and consumed credits are non-refundable.
7. Third-Party Services and Models
The Services may rely on third-party infrastructure, payment processors, authentication providers, cloud services, AI model providers, or marketplace providers. Their terms and policies may apply to your use of those features.
Third-party content, models, or integrations may be modified, suspended, or discontinued. NamiFusion is not responsible for third-party services outside our control.
8. Data Retention and Availability
Generated files and other workspace data may be stored for a limited period depending on the feature, plan, or technical constraints. You should download and preserve any Output you need to keep.
We do not guarantee permanent storage, recovery, or availability of any Input, Output, project, history item, or API result unless expressly agreed in writing.
9. Disclaimers
The Services and Output are provided “as is” and “as available.” AI systems are probabilistic and may produce inaccurate, incomplete, offensive, unsafe, or unexpected results. NamiFusion does not warrant that Output is correct, lawful for your use case, non-infringing, unique, or fit for a particular purpose.
You are responsible for human review, rights clearance, legal compliance, and decisions based on Output.
10. Limitation of Liability
To the maximum extent permitted by law, NamiFusion will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities.
To the maximum extent permitted by law, NamiFusion’s total liability for any claim relating to the Services will not exceed the greater of USD $100 or the amount you paid to NamiFusion for the Services giving rise to the claim in the 12 months before the event giving rise to liability.
11. Termination
You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create legal risk, misuse the Services, fail to pay amounts due, or where continued service is no longer commercially or technically feasible.
Sections that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitations of liability, and dispute provisions.
12. Changes
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Services after changes become effective means you accept the updated Terms.
